DMV Housing - Section 8 Housing Solutions Excellence

1. Agreement to Terms

By accessing or using DMV Housing services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our services. These Terms apply to all visitors, users, landlords, tenants, and others who access or use our Services.

2. Service Description

DMV Housing provides:

Section 8 housing assistance and consultation
Tenant-landlord matching services
RFTA (Request for Tenancy Approval) processing assistance
HAP (Housing Assistance Payment) setup guidance
HQS (Housing Quality Standards) inspection coordination
Meet and Lease event organization

Note: DMV Housing is NOT a government agency. We are a private service provider that assists with Section 8 processes. Official determinations are made by DC Housing Authority (DCHA) and HUD.

3. Eligibility and Account Registration

To use our Services, you must:

Be at least 18 years of age
Be legally authorized to form binding contracts
Provide accurate, current, and complete information
Maintain the security of your account credentials
Promptly update any changes to your information
Be responsible for all activities under your account

Providing false information may result in immediate termination of services and potential legal action.

4. User Responsibilities

Landlords Must:

• Maintain properties to HQS standards
• Comply with Fair Housing laws
• Provide accurate property information
• Honor approved lease agreements
• Not discriminate against voucher holders

Tenants Must:

• Maintain valid Section 8 voucher
• Provide accurate income information
• Comply with lease terms
• Allow required inspections
• Report changes promptly

5. Prohibited Activities

You may NOT use our Services to:

Violate any federal, state, or local laws or regulations
Discriminate based on race, color, religion, sex, disability, familial status, or national origin
Submit false or misleading information
Engage in fraudulent activity related to housing assistance
Harass, abuse, or harm other users
Impersonate others or misrepresent affiliation with any entity
Interfere with or disrupt the Services or servers
Attempt unauthorized access to any portion of the Services
Collect or harvest user information without consent
Use automated systems or software to extract data

6. Fair Housing Compliance

DMV Housing strictly adheres to the Fair Housing Act and all applicable fair housing laws. We maintain a zero-tolerance policy for discrimination.

Source of Income Protection: In Washington D.C., it is illegal to refuse to rent to someone because they have a Housing Choice Voucher (Section 8) or other lawful source of income.

Violations will be reported to HUD\'s Office of Fair Housing and Equal Opportunity (FHEO) and may result in:

Civil penalties up to $21,039 for first violation
Criminal prosecution for pattern violations
Permanent ban from our Services

7. Intellectual Property Rights

The Services and all content, features, and functionality are owned by DMV Housing and are protected by copyright, trademark, and other intellectual property laws. You may not:

Copy, modify, or create derivative works
Use for commercial purposes without written permission
Remove any copyright or proprietary notations
Transfer or "mirror" any content on any other server

8. Disclaimers and Limitations of Liability

No Guarantee of Housing

DMV Housing does not guarantee housing placement, voucher approval, or successful tenant-landlord matches. Final decisions rest with DCHA and participating parties.

Service "AS IS"

Services are provided "AS IS" without warranties of any kind. We do not warrant that services will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, DMV Housing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or revenues.

9. Indemnification

You agree to indemnify, defend, and hold harmless DMV Housing, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services or violation of these Terms.

10. Termination

We may terminate or suspend your account and access to Services immediately, without prior notice, for:

Breach of these Terms
Violation of applicable laws
Fraudulent or illegal activity
Providing false information
Actions harmful to other users or our operations

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that should survive termination shall survive.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the District of Columbia without regard to conflict of law principles.

Arbitration Agreement

Any dispute arising from these Terms or your use of Services shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

Class Action Waiver: You agree to bring claims only in your individual capacity and not as part of any class or representative action.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on our Services. Continued use after changes constitutes acceptance of modified Terms.

13. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that comes closest to the intent of the original.
